General Terms and Conditions
1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Bestellungen, die über den Online-Shop www.p-magon.com der Frowein Beteiligungs GmbH, Johannisstrasse 9, 20457 Hamburg (nachfolgend „Verkäufer") abgeschlossen werden.
2. Vertragspartner und Vertragsschluss
Der Kaufvertrag kommt zustande mit der Frowein Beteiligungs GmbH. Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar. Mit dem Absenden der Bestellung gibt der Kunde ein verbindliches Angebot ab. Der Verkäufer bestätigt den Eingang der Bestellung per E-Mail. Der Kaufvertrag kommt erst mit der Versandbestätigung zustande.
3. Angebote und Preise
Alle Preise sind Endpreise in Euro und enthalten die gesetzliche Mehrwertsteuer. Versandkosten werden separat ausgewiesen und sind vom Käufer zu tragen.
4. Zahlung
Die Zahlung erfolgt über die im Shop angebotenen Zahlungsmethoden. Der Rechnungsbetrag ist sofort fällig.
5. Lieferung
Die Lieferung erfolgt an die vom Kunden angegebene Lieferadresse. Lieferzeiten sind Schätzungen und können variieren. Der Verkäufer behält sich das Recht vor, bei Nichtverfügbarkeit eines Produkts vom Vertrag zurückzutreten und den Kunden unverzüglich zu informieren.
6. Widerrufsrecht
Verbrauchern steht ein gesetzliches Widerrufsrecht zu. Näheres ergibt sich aus der gesonderten Widerrufsbelehrung.
7. Eigentumsvorbehalt
Die gelieferte Ware bleibt bis zur vollständigen Bezahlung Eigentum des Verkäufers.
8. Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte. Bei gebrauchten Waren wird die Gewährleistungsfrist auf ein Jahr verkürzt, sofern gesetzlich zulässig.
9. Haftung
Der Verkäufer haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit. Bei leichter Fahrlässigkeit haftet der Verkäufer nur bei Verletzung wesentlicher Vertragspflichten, begrenzt auf den vorhersehbaren, vertragstypischen Schaden.
10. Streitbeilegung
Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit: https://ec.europa.eu/consumers/odr. Wir sind nicht bereit und nicht verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
11. Anwendbares Recht
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.

These General Terms and Conditions apply to all orders placed via the online shop www.p-magon.com Frowein Beteiligungs GmbH, Johannisstrasse 9, 20457 Hamburg (hereinafter referred to as the "Seller").
2. Contracting Party and Conclusion of Contract
The purchase agreement is concluded with Frowein Beteiligungs GmbH. The presentation of the products in the online shop does not constitute a legally binding offer. By submitting the order, the customer submits a binding offer. The seller will confirm receipt of the order by e-mail. The purchase contract is only concluded with the shipping confirmation.
3. Offers and prices
All prices are final prices in euros and include VAT. Shipping costs are shown separately and are to be borne by the buyer.
4. Payment
Payment is made via the payment methods offered in the shop. The invoice amount is due immediately.
5. Delivery
Delivery will be made to the delivery address provided by the customer. Delivery times are estimates and may vary. The Seller reserves the right to withdraw from the contract in the event of unavailability of a product and to inform the Customer immediately.
6. Right of withdrawal
Consumers have a statutory right of withdrawal. More details can be found in the separate cancellation policy.
7. Retention of title
The delivered goods remain the property of the seller until full payment has been made.
8. Warranty
The statutory warranty rights apply. For used goods, the warranty period is shortened to one year, if permitted by law.
9. Liability
The seller is liable without limitation for intent and gross negligence. In the event of slight negligence, the seller shall only be liable in the event of a breach of essential contractual obligations, limited to the foreseeable damage typical of the contract.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Applicable Law
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
